new eligibility criteria for open work permits FOR SPOUses of foreign workers

The eligibility criteria for spousal open work permits for the spouses of foreign workers have been updated as of January 21, 2025.

As of January 21, 2025, spousal open work permits will only be granted if the main applicant:

  • Works in a TEER 0 or TEER 1 role, as defined by Canada's National Occupational Classification (NOC), which includes mainly managerial and professional positions; or

  • Works in specific TEER 2 or TEER 3 roles that are facing labor shortages or are in line with government priorities. The complete list of these occupations has been listed in Appendix A below. 

The principal applicant must also have a valid work permit with at least 16 months of validity remaining when the spousal application is submitted.
